  2.                  Evaluation User License Agreement

  5. This is an agreement between Step Ahead Software Pty Limited (to be 
  6. hereinafter referred to as "Step Ahead Software") and you, the end user, of 
  7. an evaluation copy of the software program, JAVelin.
  8.

  17. The software program "Javelin" and its accompanying distribution files (to 
  18. be hereinafter collectively referred to as the "Software"), is and shall 
  19. remain the property of Step Ahead Software. In addition and without any 
  20. limitation to the foregoing the rights to reproduce, multiply and make 
  21. copies of the Software is an shall remain the exclusive property of 
  22. Step Ahead Software except as otherwise provided for in this agreement. The 
  23. Software is protected by all applicable copyright laws and international 
  24. treaties.

  28. Step Ahead Software grants you the right to use the Software on a single 
  29. computer constrained by the following:

  31. Evaluation License - Applies if you have not purchased a full user license
  32. and password from Step Ahead Software
  33. --------------------------------------------------------------------------
  34. The use of this evaluation version is further constrained as follows:
  35. (1) Use is for evaluation only. You are not granted the right to distribute
  36. any JAVA programs, source code or class files produced with the assistance
  37. of this evaluation product
  38. (2) You must not use the JAVelin evaluation after the expiry date
  39. advised when you first downloaded the evaluation verion.
  40. If you wish to use this product after this date you must purchase a
  41. real (non evaluation) copy (see order.txt in the distribution files or
  42. http://www.ozemail.com.au/~stepsoft for details of how to do this).

  44. The conditions below under "Both licenses" also apply to this evaluation
  45. license.

  47. Full User License - Applies only if you have purchased a full user license
  48. and password from Step Ahead Software
  49. --------------------------------------------------------------------------
  50. You may only use the serial number and password which you have purchased
  51. from Step Ahead Software. You will not reveal your password to other parties
  52. and will not use other party's passwords.

  54. The conditions below under "Both licenses" also apply to this full user
  55. license.

  58. Both Licenses - Applies to both evaluation and full user license.

  60. You will remain solely responsible to anyone receiving a program made by
  61. you which includes any code generated by using this Software. You will 
  62. indemnify and hold Step Ahead Software and its suppliers harmless from and 
  63. against any claims or liabilities arising out of the use, reproduction or 
  64. distribution of the program.

  66. You will not disassemble or reverse compile or reverse engineer the 
  67. Software or any portion of the Software.
  68.  
  69. This program is provided "as is" without warranty of any kind, either 
  70. expressed or implied, including but not limited to implied warranties of 
  71. merchantability and fitness for a particular purpose.

  73. In no event will Step Ahead Software be liable to you for any damages, 
  74. including, but not limited to, any lost profits, lost savings, or any other 
  75. incidental or consequential damages arising out of the use or inability to 
  76. use this program, even if Step Ahead Software has been advised of such 
  77. damages, or for any other claim by any other party.

  79. Step Ahead Software does not warrant that JAVelin supports or utilises 
  80. every feature of the Java language. The sole risk in determining whether or 
  81. not JAVelin is appropriate for your use lies with you.

  83. If for any reason any portions of this agreement are not enforceable or 
  84. unlawful then all other remaining portions will still form a valid license 
  85. agreement.

  87. Distribution of Javelin Professional (Evaluation)
  88. =================================================
  89. Persmission is hereby granted for you to distribute this software (not including
  90. serial numbers or passwords) via web sites, BBSs, floppy disks or CD-ROMs
  91. provided that the software is distributed whole and complete and unchanged in
  92. any way and provided that no serial numbers or passwords are supplied with the
  93. distribution or any references or associations are made to serial numbers or
  94. passwords which may unlock this evaluation version. You must not charge for
  95. distributing this software except in the case of distribution via floppy disk
  96. or CD-ROM where reasonable charges may be made to cover the cost of media
  97. etc., You must not charge for downloading from a web site or BBS. You must
  98. notify Step Ahead Software by email that you wish to distribute the evaluation
  99. software so that we can contact you when we release updates etc., (email:
  100. stepsoft@ozemail.com.au). We may even provide to your web site from ours if
  101. we feel it is appropriate.
